Terms of Service

The use of any Services from ANAdesigns.net [hereafter referred to as "ANA"] by you [hereafter referred to as "Customer"] constitutes agreement to these terms.

General Terms of Service

ACCOUNT SETUP / EMAIL ON FILE:

ANA allows you to set up an account without placing an order with us. During the order process, ANA will set up your account automatically. It is Customer’s responsibility to provide us with an email address which is not @ the domain(s) you are signing up for (if any). If there is ever an abuse issue or we need to contact you, the primary email address on file will be used for this purpose. It is your responsibility to ensure the email address on file is current and up to date at all times. Providing false contact information of any kind may result in the termination of your account.

PAYMENT INFORMATION:
Customer agrees to supply appropriate payment for the services received from ANA, in advance of the time period during which such services are provided. You agree that until and unless you notify ANA of your desire to cancel any or all services received, all services except for one-time charge products and services will be billed on a recurring basis.

ANA accepts the following methods of payment:
- Visa/Mastercard/Discover (use of gift cards is not permitted)
- Google Checkout
- US Postal or Bank money order
- Prepaid card (please contact ANA Designs for specific information prior to ordering)

As a Customer of ANA, it is your responsibility to ensure that your payment information is up to date and that all invoices are paid on time. ANA provides a 3 day grace period from the time the invoice is generated to when it must be paid. Any invoice that is outstanding for 14 days and not paid will result in a $20 late fee and/or an account suspension until account balance has been paid in full.

All ANA Website Design Packages require a 50% non-refundable deposit before any work begins. The remaining 50% is due upon completion of your website. Starter sites must be paid for in full before any work begins.

There are no refunds on Website Design Packages, Starter Sites, WordPress Themes, Webmaster Services, Domain Registration, or other ANA Services and products. All sales are final.

CANCELLATIONS AND REFUNDS:
ANA reserves the right to cancel any Customer’s account at any time with or without notice.

Any abuse of our staff in any medium or format will result in the suspension or termination of Customer’s services.

Cancellations must be done in writing via Support Ticket. Once we receive your cancellation and have confirmed all necessary information with you via e-mail, we will inform you in writing (typically via email) that your account has been canceled. Your cancellation confirmation will contain a ticket/tracking number in the subject for your reference and for verification purposes. You should immediately receive an automatic “Your cancellation request has been received…” email with a tracking number. We require that cancellations of service are done through this method to (a) confirm your identity, (b) confirm in writing you are prepared for all files/emails to be removed, and (c) document the request. This process reduces the likelihood of mistakes, fraudulent/malicious requests, and ensures you are aware that the files, emails, and account may be removed immediately after a cancellation request is processed.

MONEY BACK GUARANTEE:
If you are not completely satisfied with our hosting services within the first 30 days of your service, you will be given a full refund of the contract amount. This does not apply to Website Design Packages, Domain Registration, or Webmaster and other services and products.

This guarantee applies only to monthly-billed hosting service, to any customer who paid the first invoice with a credit card payment.

The following methods of payments are subject to a $10 cancellation fee:

Money orders
Only first-time accounts are eligible for a refund. For example, if you’ve had an account with us before, canceled and signed up again, you will not be eligible for a refund, or if you have opened a second account with us.

Violations of the Terms of Service will waive the refund policy.

CREDIT CARD AND OTHER CHARGES:
If Customer has an issue with credit card charges, contact ANA regarding the issue before contacting your credit card company to request a charge back or reversal of the charges. In the event of a charge back by a credit card company (or similar action by another payment provider allowed by us) in connection with your payment of fees for any service(s), Customer agrees that we may suspend access to any and all accounts you have with us and all rights to and interest in and use of services. ANA will reinstate your rights to and control over services solely at our discretion, and subject to our receipt of the unpaid fee(s) and our then-current reinstatement fee, currently set at $100(US Dollars).

PRICE CHANGE:
The amount you pay for an ANA Service will never increase from the date of purchase. We reserve the right to change prices listed on www.anadesigns.net, and the right to increase or decrease the amount of resources and benefits given to Packages at any time.

COUPONS:
Coupon abuse will not be tolerated and may result in the suspension or termination of the account.

INDEMNIFICATION:
Customer agrees that it shall defend, indemnify, save and hold ANA harmless from any and all demands, liabilities, losses, costs and claims, including reasonable attorney’s fees asserted against ANA, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, its agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless ANA against liabilities arising out of; (a) any injury to person or property caused by any products sold or otherwise distributed in connection with ANA; (b) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party; (c) copyright infringement and (d) any defective products sold to customers by ANA.

Customer agrees that they are not using, nor intending to use, any ANA services to conduct business illegally or to perform activities that violate local, state, federal, or international laws. All Services provided by ANA may be used for lawful purposes only. Customer agrees to defend, indemnify, and hold harmless ANA against any liabilities arising from the misuse of our services. It is the responsibility of the Customer to register your business with local city and state laws.

ARBITRATION:
By using any ANA services, you agree to submit to binding arbitration. If any disputes or claims arise against ANA, such disputes will be handled by an arbitrator of ANA’s choice. An arbitrator from the American Arbitration Association or the National Arbitration Forum will be selected in the state of Pennsylvania. Arbitrators shall be attorneys or retired judges and shall be selected pursuant to the applicable rules. All decisions rendered by the arbitrator will be binding and final. The arbitrator’s award is final and binding on all parties. The Federal Arbitration Act, and not any state arbitration law, governs all arbitration under this Arbitration Clause. Customer is responsible for any and all costs related to such arbitration.

IF LAWSUIT(S) ARE THREATENED:
If ANA is sued or threatened with lawsuit in connection with service(s) provided to you, we may turn to you to indemnify us and to hold us harmless from the claims and expenses (including attorney’s fees and court costs). Under such circumstances, you agree that you will, upon demand, obtain a performance bond with a reputable bonding company or, if you are unable to obtain a performance bond, that you will deposit money with us to pay for our reasonably anticipated expenses in relation to the matter. Such deposit will be drawn down as expenses are incurred, with all account notices sent to the WHOIS contact information provided in association with your domain names and/or account. ANA will not be obliged to extend you any credit in relation to such expenses and we may terminate the Services for a failure to make or renew such a deposit. We will return any unused deposit upon the later of one year from deposit or the conclusion of the matter.

DISLCLAIMER:
ANA shall not be responsible for any damages Client’s business may suffer. ANA makes no warranties of any kind, expressed or implied, for services we provide. ANA disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, no deliveries, wrong delivery, and any and all service interruptions
caused by ANA and its employees.

Design Terms of Service

In order to purchase an ANA Website Design Package, you must be a legal adult at least 18 years of age.

All ANA sites are written in XHTML transitional and all pages are guaranteed to validate through W3C unless otherwise noted.

ANA Website Designs have a standard text link to http://www.anadesigns.net in the footer of the website. Customer agrees not to remove this link unless given permission in writing from ANA.

ANA reserves the right to display a screen shot and/or text link to all completed websites on our Portfolio page.

Deposits on all Web Design Packages are non-refundable.

TEMPLATE SALES:
Any website template sold, either as an Website Template Package or As-is Template Sale, constitutes a one-time only license. Customer may not redistribute or resell ANA templates under any circumstances. Doing so constitutes a violation of the ANA Terms of Service and will result in prosecution at Customer’s expense.

WEBSITE DESIGN AND TEMPLATE PACKAGES:
Customer must supply all requested information and materials before ANA begins any website design. You must supply all the text for your website and the corresponding pages on which it will appear. Failure to supply this information within 30 days of your initial payment violates ANA’s Terms of Service and may result in the cancellation of your account
without refund.

After receiving the required information, ANA will begin the website design process and send you either a screen shot or a link to a private web page with the first draft of your website for review and feedback when ready. Once you approve your final design, ANA will make the pages and send them either via screen shots or loaded into a private web page for you to view. At this time you may request any final revisions.
Customer’s completed website emailed via an attached ZIP file constitutes delivery of Website Design Package. If Customer chooses to take advantage of our accompanied services, ANA will upload your website for you.

Fees quoted are based an estimate of the time needed to create your website. If Customer’s needs exceed reasonable expectations, you may be required to pay an additional fee in order for work to continue. If, within 40 working hours, a design idea can not be agreed upon, Customer may cancel service. In this case, no deposit will be returned to you, and any code, images, or any other design elements or graphics used in the cancelled service become property of ANA and Customer has no authorization to use them.

Upon completion of your website design and full payment, ANA agrees not to resell or reuse your website design.

CONTENT:
Customer agrees that any text, photos, or any other material you supply ANA for your website design does not infringe on any copyright laws. ANA will not be held liable for any claim arising from copyright infringement or improper use of content. Any website found to be in violation of nother’s copyright will be removed, or access to the material suspended.

Images of models under 18 years of age and material that is false, defamatory, abusive, obscene, threatening, or in violation of any law is prohibited.

ADDITIONAL SERVICES:
ANA provides additional services for some Design Packages, such as free domain registration, website hosting, and website updates for one year. Customer has the option of accepting or declining these services at any time.

All website update requests will be completed as quickly as possible. Text and banner updates usually are done within 24 hours and photo updates within three days. ANA will make every effort to have Customer’s request completed in a timely manner but reserves the right to delay any update requests.

Free updates are available for one year with some ANA Website Design Packages. This does not give Customer a right to request ANA to update your site daily. More than three update requests on a regular basis constitutes abuse and may result in the suspension or cancellation of your service.

WEBSITE DESIGN TEMPLATE AS-IS SALES:
Website Template As-is sales constitutes a one-time use license only. Client may not under any circumstances redistribute or resell any template you purchase through ANA. All sales are final.

All Template pages are guaranteed to validate to current W3C standards and have been tested in all major browsers. ANA does not guarantee Internet Explorer 7 and below compatibility with any Template As-is sale.

Once Client’s payment is received and order processed, Client will be able to download the purchased template directly from ANA’s Client area.

The amount of pages Client receives corresponds to the amount of pages in the menu of the chosen design. Most images are in jpg png or gif format. Some templates contain menu or header images in psd format. Photoshop is required to edit these images. Those images in .png format are not compatible with Internet Explorer 6. Each page contains stock text. ANA’s photo gallery and forms are not available with this option. The gallery page contains stock text. Though custom scrollbars with simple instructions for modification are included in applicable templates, Client must supply their own forms and gallery scripts.

This option also does not include any customizations or customer support help. Hosting and domain registration are also not included.

ANA reserves the right to display purchased templates on anadesigns.net for up to 30 days from the time of payment.

Hosting Terms of Service

CONTENT:
All sites hosted with ANA containing adult-oriented content must provide a disclaimer on the first page, stating the site is adult in nature. No site hosted with ANA may have graphic sexual depictions in public areas and may be used for lawful purposes only. Pornographic sites are not permitted on ANA servers.

Use of our Hosting Services to infringe upon any copyright or trademark is prohibited. This includes but is not limited to unauthorized copying of music, books, photographs, or any other copyrighted work. The offer of sale of any counterfeit merchandise of a trademark holder will result in the immediate termination of your account. Any Hosting Account found to be in violation of another’s copyright will be removed, or access to the material disabled. Any account found to be in repeated violation of copyright laws will be suspended and/or terminated from our hosting. If you believe that your copyright or trademark is being infringed upon, please email abuse@anahosting.net with the information required. If the request is of a licensing issue, we may require further documentation.

Using a Hosting Account as a backup/storage device is not permitted, with the exception of one cPanel backup of the same account. You are not permitted to retain multiple backups on your hosting account.

ANA services, including all related equipment, networks and network devices are provided only for authorized customer use. ANA systems may be monitored for all lawful purposes, including to ensure that use is authorized, for management of the system, to facilitate protection against unauthorized access, and to verify security procedures, survivability, and operational security. During monitoring, information may be examined, recorded, copied and used for authorized purposes. Use of ANA system(s) constitutes consent to monitoring for these purposes.
ANA reserves the right to refuse service to anyone. Any material that, in our judgment, is defamatory, abusive, obscene, threatening, or violates our terms of service in any manner may be removed from our servers (or otherwise disabled), with or without notice.
Failure to respond to contact from our abuse department within 48 hours may result in the suspension or termination of your service(s). All abuse issues must be dealt with via Support Ticketl and will have a response within 48 hours.

Potential harm to minors is strictly forbidden, including but not limited to child pornography or content perceived to be child pornography. Any site found to host child pornography or linking to child pornography will be suspended immediately without notice.
Violations will be reported to the appropriate law enforcement agency.

It is your responsibility to ensure that scripts/programs installed under your account are secure and permissions of directories are set properly, regardless of installation method. When at all possible, set permissions on most directories to 755 or as restrictive as possible. Users are ultimately responsible for all actions taken under their account. This includes the compromise of credentials such as user name and password. It is required that you use a secure password. If a weak password is used, your account may be suspended until you agree to use a more secure password. Audits may be done to prevent weak passwords from being used. If an audit is performed, and your password is found to be weak, we will notify you and allow time for you to change/update your password.

ZERO TOLERANCE SPAM POLICY:
ANA takes a zero tolerance stance against sending of unsolicited e-mail, bulk emailing, and spam. “Safe lists” and purchased lists will be treated as spam. Any user who sends out spam will have their account suspended or terminated with or without notice.
Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This provision includes, but is not limited to SPAM sent via fax, email, instant messaging, or usenet/newsgroups. No organization or entity listed in the ROKSO may be hosted on our servers. Any account which results in our IP space being blacklisted will be immediately suspended and/or terminated.
ANA reserves the right to require changes or disable as necessary any web site, account, database, or other component that does not comply with its established policies, or to make any such modifications in an emergency at its sole discretion.
ANA reserves the right to charge the holder of the account used to send any unsolicited e-mail a clean up fee or any charges incurred for blacklist removal. This cost of the clean up fee is entirely at the discretion of ANA.

BACKUPS AND DATA LOSS:
Your use of this service is at your sole risk. Our backup service is provided to you as a courtesy. ANA is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on ANA servers.

Should you need ANA to restore your site from backup, a $20 fee will apply. Processing time for backups is up to 24 hours. Full site restoration is not guaranteed.

RESOURCE USAGE:
User may not:
Run stand-alone, unattended server-side processes at any point in time on the server. This includes any and all daemons, such as IRCD.
Run any type of web spider or indexer (including Google Cash / AdSpy).
Run any software that interfaces with an IRC (Internet Relay Chat) network.
Run any bit torrent application, tracker, or client. You may link to legal torrents off-site, but may not host or store them on our servers.
Run cron entries with intervals of less than 15 minutes When using PHP include functions for including a local file, include the local file rather than the URL. Instead of include(“http://yourdomain.com/include.php”) use include(“include.php”)
ANA hosting accounts provide cPanel access to hundreds of downloadable templates. More than five downloads per day constitutes abuse of this benefit and will result in your account being suspended.

BANDWIDTH USAGE:
You are allocated a monthly bandwidth allowance. This allowance varies depending on the Hosting Package you purchase. Should your account pass the allocated amount we reserve the right to suspend the account until the start of the next allocation, suspend the account until you upgrade to a higher level of package, terminate the account and/or charge you an additional fee for the overages. Unused transfer in one month cannot be carried over to the next month.

UPTIME GUARANTEE:
If our server has a physical downtime that is not within the 99.9% uptime guarantee, you may receive one month of credit on your account. Approval of the credit is at the discretion of ANA dependent upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor’s network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact support@anahosting.net with justification. All requests must be made in writing via email.

Domain Registration Agreement

SERVICE PROVIDED AND TERMINATION OF SERVICE:
ANA reserves the right to reject Customer’s domain name registration application or elect to discontinue providing Service to you for any reason within 30 days of a Domain purchase or renewal. Outside of this period, we may terminate or suspend the Service at any time for cause, which includes registration of prohibited domain name(s), abuse of ANA Services or staff, non-payment or payment irregularities, serious allegations of illegal conduct, or if your use of ANA Services involves us in a violation of any Internet Service Provider’s acceptable use policies, including the transmission of unsolicited bulk email. If we terminate or suspend the Services provided to you under this Agreement, we may then, at our option, make either ourselves or a third party the beneficiary of Services which were previously provided to you. If we have grounds to terminate or suspend Service with respect to one domain name, we may terminate or suspend all Service(s) provided through your account, including Service(s) to other domain names, Hosting Accounts, and Design Services. No refund will be made when there is a suspension or termination of Service(s) for just cause. At any time and for any reason, we may terminate the Services 30 days after we send notice of termination via email to the WHOIS contact information provided in association with your domain name registration. Following notice of termination other than for cause, you must transfer your domain name or risk that we may delete your domain name or suspend or modify Services to it. If we terminate Services for a reason other than cause, we will attempt to refund your fees.

OUR SERVICES:
ANA is a registrar through Enom for Top Level Domain Names (“TLDs”) (such as .com, .net, .org, .biz, etc.). Domain name registrations are not effective until the registry administrator puts them into effect. Domain name registrations are only for limited terms which end on the expiration date. For domain names that are created as a new registration out of the available namespace, the term begins on the date the domain name registration is acknowledged by the applicable registry. You agree that we are not liable or responsible in any way for any errors, omissions or any other actions by the registry administrator arising out of or related to a request to register, renew, or modify the settings for, a domain name registration. Domain name registration is an ANA Service and that domain name registration does not exist independently from services provided pursuant to this or a similar registration agreement with a registrar. Domain name registration services do not create a property interest.

YOUR USE OF ANA SERVICES DOES NOT SUBJECT US TO ANY CLAIM(S):
Customer agrees to indemnify, defend and hold harmless ANA, your Primary Service Provider, and applicable registry administrator(s) and all such parties’ directors, officers, employees, and agents from and against any and all claims, damages, liabilities, costs, and expenses (including any direct, indirect, incidental, special or consequential damages and reasonable legal fees and expenses) arising out of, or related to, the domain name registration service you are obtaining from ANA.

NOT INCLUDED IN THE SERVICES:
The following are not included in the Services: We do not check to see whether the domain name(s) you select, or the use you make of the domain name(s), or other of the Service(s), infringes upon the legal rights of others. It is your responsibility to know whether or not the domain name(s) you select or use infringes legal rights of others. We might be ordered by a court to cancel, modify, or transfer your domain name; it is your responsibility to list accurate contact information in association with your account and to communicate with litigants, potential litigants, and governmental authorities. It is not ANA’s responsibility to forward court orders or other communications to you. We will comply with court orders unless you contact us to contest the order.

FEES:
Customer may select automatic renewal of the Service and agree to pay, prior to the effectiveness of the desired Service(s) renewal, the applicable fees. All fees are non-refundable, in whole or in part, even if your domain name registration is suspended, cancelled or transferred prior to the end of your then current registration term, unless this Agreement specifically provides for a refund. At our option, we may require that you pay fees through a particular payment means (such as by credit card) or that you change from one payment provider to another.

EXPIRATION AND RENEWAL OF SERVICE(S):
It is your responsibility to keep your own records regarding when your domain name registration is set to expire. As a convenience to you, and not as a binding commitment, we may notify you via an email message prior to when renewal fees are due. Should these fees go unpaid, your Services will expire or be cancelled. If you select automatic renewal of the Service, we may attempt to renew the Service a reasonable time before expiration, provided your credit card or other billing information is available and up to date. It is your responsibility to keep your billing information up to date. We are not required to but may contact you to update this information in the event that an attempted transaction is not processed successfully.

ACCOUNT CONTACT INFORMATION AND DOMAIN NAME WHOIS INFORMATION:
Customer agrees to provide current, complete and accurate information about you with respect to the WHOIS information for your domain name(s). It is up to you to maintain and update this information as needed to keep it current, complete and accurate. For the administrative, technical, and billing contacts for your domain name registration and other Service, you must submit the following: name, postal address, e-mail address, telephone number, and fax number (if available). You agree that the type of information you are required to provide may change and you understand that, if you do not provide the newly required information, your registration or and/or other Service may be suspended or terminated or may not be renewed. Not providing requested information may prevent you from obtaining Service.

YOUR OBLIGATIONS AND REPRESENTATIONS RELATING TO THE ACCOUNT AND WHOIS CONTACT INFORMATION:
In the event that, in registering a domain name, you provide information about or on behalf of a third party, you represent that you have provided notice to that third party of the disclosure and use of that party’s information as set forth in this Agreement, and that you have obtained the third party’s express consent to the disclosure and use of that party’s information as set forth in this Agreement. By registering a domain name or applying for other Service you also represent that the statements in your application are true and you also represent that the domain name is not being registered or the Services being procured for any unlawful purpose. Providing inaccurate information or failing to update information promptly will constitute a breach of this Agreement and will be sufficient basis for suspension or termination of Services to you. Your failure to respond for over ten (10) calendar days to inquiries by ANA concerning the accuracy of account and WHOIS contact information shall constitute a breach of this Agreement and will be sufficient basis for suspension or termination of Service to you. As indicated elsewhere in this Agreement, you understand that it is important for you to regularly monitor email sent to the email address associated with your account and WHOIS contact information because, among other reasons, if a dispute arises regarding a domain name or other Service, you may lose your rights to the domain name or your right to receive the Service if you do not respond appropriately to any email sent regarding the matter.

ACCESSING YOUR ACCOUNT AND A LIMITATION OF OUR LIABILITY:
Customer must access your account with ANA in order to change any of your account or domain name WHOIS information. Please safeguard your password from any unauthorized use. Any person in possession of you account login ID and password will have the ability and your authorization to modify your account and domain name information. ANA takes reasonable precautions to protect the information we obtain from you from loss, misuse, unauthorized access or disclosure, alteration or destruction of that information and that such reasonable precautions include procedures for releasing account access information to parties who claim to have lost account access information. You agree that, if we take reasonable precautions in relation thereto, that IN NO EVENT SHALL WE BE LIABLE IF SUCH REASONABLE PRECAUTIONS DO NOT PREVENT THE UNAUTHORIZED USE OR MISUSE OF YOUR ACCOUNT IDENTIFIER OR PASSWORD AND THAT, EVEN IF WE FAIL TO TAKE REASONABLE PRECAUTIONS, THAT OUR LIABILITY UNDER ANY CIRCUMSTANCES SHALL BE LIMITED BY THE LIMITATION OF LIABILITY PROVISION FOUND BELOW IN THIS AGREEMENT. If you contact ANA alleging that a third party has unauthorized access to your account or domain names, you agree that ANA may charge you administrative fees of $40 per hour for our time spent in relation to the matter, regardless of whether or not ANA returns control over the account and/or domain names to you.

PRIVACY POLICY:
ANA will make available the domain name registration information you provide or that we otherwise maintain to the following parties: ICANN, the registry administrator(s), and to other third parties as ICANN and applicable laws may require or permit (including through web-based and other on-line WHOIS lookup systems), whether during or after the term of your domain name registration services of the domain name. You waive any and all claims and causes of action you may have arising from such disclosure or use of such information. Additionally, you acknowledge that ICANN may establish or modify the guidelines, limits and/or requirements that relate to the amount and type of information that we may or must make available to the public or to private entities, and the manner in which such information is made available. Information regarding ICANN’s guidelines and requirements regarding WHOIS can be found at ICANN You agree that ANA may make publicly available, or directly available to third parties, some, or all, of the information you provide, for purposes of inspection (such as through our WHOIS service) or for targeted marketing and other purposes as required or permitted by applicable laws.

OWNERSHIP OF INFORMATION AND DATA:
You agree and acknowledge that ANA owns all database, compilation, collective and similar rights, title and interests worldwide in our domain name database, and all information and derivative works generated from the domain name database. ANA owns the following information for those registrations for which we are the registrar: (a) the original creation date of the registration, (b) the expiration date of the registration, (c) the name, postal address, e-mail address, voice telephone number, and where available fax number of all contacts for the domain name registration, (d) any remarks concerning the registered domain name that appear or should appear in the WHOIS or similar database, and (e) any other information we generate or obtain in connection with the provision of domain name registration services, other than the domain name being registered, the IP addresses of the primary nameserver and any secondary nameservers for the domain name, and the corresponding names of those nameservers. ANA does not have any ownership interest in your specific personal registration information outside of our rights in our domain name database.

AGENTS AND LICENSES:
You agree that, if you are registering a domain name for or on behalf of someone else, you have the authority to bind that person as a principal to all terms and conditions provided herein. If you license the use of the domain name registered to you to a third party, you nonetheless remain the domain name holder of record, and remain responsible for all obligations under this Agreement, including but not limited to payment obligations, and providing (and updating, as necessary) both your own full contact information, and accurate technical, administrative, billing and zone contact information adequate to facilitate timely resolution of any problems that arise in connection with the domain name and domain name registration.

AFTER EXPIRATION OF THE TERM OF A DOMAIN NAME REGISTRATION:
Immediately after the expiration of the term of domain name registration services and before deletion of the domain name in the applicable registry’s database, you acknowledge that ANA may direct the domain name to name-servers and IP address(es) designated by us, and that ANA may either leave your WHOIS information intact or that we may change the contact information in the WHOIS output for the expired domain name so that you are no longer the listed registrant of the expired domain name.

ANA reserves the right to revise its policies at any time without notice.
